Ok, I love the Decemberists; they're one of my favorite contemporary bands, but it really sounds like Meloy's ripping off R.EM. with this one. Is it just me?

I don't know about ripping off, maybe similar but idk. Also if that's the only thing you've heard by The Decemberists you must check out their earlier work, like The Crane Wife and The Hazards of Love

Oh no don't worry. Crane Wife is easily one of my top albums of the 2000s as was Picaresque. Also Colin Meloy is one of my all time favorite lyricists. I'll admit that i wasn't too thrilled about The King is Dead, but I still enjoyed the album for the most part

I guess they sound similar but that could just be an accident, I doubt the Decemberists would rip-off another song.

I've actually had the extreme pleasure of having played both of these songs in bands. And onstage, these two are nothing alike at all. The One I Love is more of a rock song, with really not much going on lyrically. It's much more electric, and much simpler. Down By The Water is more like playing The Band than it is R.E.M.. This song may not sound like it on record, but it has tons of space that The One I Love doesn't have, and it's by far the best live tune of the two. More people know The One I Love...but more people tend to like Down By The Water.

For me its I think the Decemberists version is better purely because I hate the sound of Michael Stipes voice.
